Ross & Associates Insurance Services, Inc. shares your concern for privacy and security. Accordingly, to guard your nonpublic personal information and ensure confidentiality, we maintain physical, electronic, and procedural safeguards to comply with applicable laws arising under Title V of the Gramm-Leach-Bliley Act and regulations adopted by the Oregon State Department of Consumer & Business Services Insurance Division. When you do business with our office, we permit only authorized employees and those authorized by law to have access to that information. Ross & Associates is committed to the establishment and maintenance of appropriate standards to protect information about you.
The following provisions explain our policy relating to the treatment and confidentiality of your personal information.
INFORMATION THAT WE COLLECT
In order to provide services that meet your needs, we collect nonpublic personal information about you from a variety of sources, including:
· applications and other forms that you submit to us;
· your transactions with us, our affiliates, and others, such as payment history, account balance, bank account number, or policy coverage information;
· consumer credit reporting agencies;
· investigative consumer reporting companies;
· state agencies responsible for collecting and maintaining driving records, auto title history, and license status;
· public records that contain information about the type, value, condition, and construction of your home or other buildings.
INFORMATION USE AND DISCLOSURE
We do not share nonpublic personal information about our customers or former customers with nonaffiliated companies except as illustrated below, and as otherwise permitted or required by law.
In the process of providing services or products to you, we may disclose information to:
Other companies who are affiliated with Ross & Associates Insurance Services, Inc. (Ross & Assoc.); companies or persons at your request; companies that provide services to us as we work on matters relating to your policy; companies that perform marketing services on our behalf, or to companies with whom we have joint marketing agreements; insurance regulators and other governmental entities as required by law.
When we use outside services or other financial institutions to assist with our marketing programs, we do not permit them to use our customer information for any other purpose. Any disclosure of your policy number or other information shall only be to a recipient authorized by law, and only in connection with informing you about our own products or services. We do not sell, trade or otherwise disclose your identity or any other personal information about you to third parties for their marketing purposes.
We do not share credit information, such as creditworthiness, credit standing, credit capacity, or credit score received with anyone. Under the Fair Credit Reporting Act we are, however, permitted to share information about your transactions or experiences with us (such as payment history) with our affiliated companies.
If at a later date we intend to disclose information that is different from that described above, you will receive a revised privacy notice and, if applicable, an opportunity to opt-out before we make any such disclosure.
CORRECTING ERRONEOUS INFORMATION
We do our best to be certain that the information in our records is accurate. If you wish to review the personal information in our records, please send a written request. Please include your name, address, policy number and a description of the information that you would like to review. We may charge a reasonable fee to collect and send the information to you.
If you believe information in our records is inaccurate or disagree about the accuracy of certain information, you may file a written statement with us describing the information that you believe to be incorrect, and information that you believe to be correct. We will send your statement to the insurance support organizations described above and to any person that you specifically designate who may have received the information within the last two years.
DISPUTES
Any controversy or claim arising out of or relating to our privacy policy shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
SALE OR TRANSFER OF INTEREST
In connection with the potential sale or transfer of its interests, Ross & Associates and its affiliates reserve the right to sell or transfer your information (including but not limited to your address, name, age, sex, zip code, state and country of residency and other information that you provide through other communication) to a third party entity that:
Concentrates its business in a similar practice or service; agrees to be Ross & Associates successor in interest with regard to the maintenance and protection of the information collected; and agrees to the obligations of this privacy statement.
